Privacy Policy

This policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Who we are

Silmod Building Consulting (ABN 17 660 981 313) (“we”, “us”, “our”) operates ESMTrack (the “Platform”), a tool for managing Essential Safety Measures (“ESM”) compliance. This Privacy Policy describes how we collect, use, disclose and protect personal information, and how you can access or correct it.

2. Personal information we collect

Depending on how you use the Platform, we may collect:

  • Account details — your name, email address, phone number, organisation/company name and, for contractors, licence number and the ESM types you cover;
  • Building and compliance data — building addresses, classifications, ESM records, schedules, inspection and maintenance records, documents and notes you upload;
  • Communications — messages, quotes, reviews and support correspondence sent through or to us;
  • Consent records — the version of our Terms and Privacy Policy you accepted, with the date, time, IP address and device/browser information;
  • Technical data — log data, device and usage information, and error diagnostics collected automatically when you use the Platform.

3. How we collect it

We collect personal information:

  • directly from you when you create an account, enter data, upload documents or contact us;
  • automatically as you use the Platform (for example, log and device data, and error reports);
  • from other Platform users where they connect with you — for example, a building owner engaging a contractor, or a contractor invited to a building.

If we cannot collect personal information we reasonably need, we may be unable to provide you with the Platform or parts of it.

4. Why we collect and use it

We use personal information to:

  • provide, operate and maintain the Platform and your account;
  • send reminders, notifications and service communications relating to ESM management;
  • facilitate connections between building owners and contractors;
  • respond to enquiries and provide support;
  • maintain security, prevent misuse, and keep records of consent;
  • improve and develop the Platform; and
  • comply with our legal obligations.

5. Disclosure to third parties

We may disclose personal information to:

  • other Platform users where necessary to provide the service — for example, an owner can see the contractors they engage, and a contractor can see the building and contact details relevant to work they are asked to perform;
  • service providers who help us run the Platform, including hosting, database, email delivery, error monitoring and (where enabled) SMS providers, who are only permitted to use the information to provide their services to us;
  • professional advisers, or law enforcement and government bodies, where required or authorised by law.

We do not sell your personal information.

6. Overseas disclosure

Some of our service providers store or process data on servers located outside Australia (for example, in the United States or European Union). Where this occurs, we take reasonable steps to ensure the information is handled consistently with the APPs.

7. Data security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including access controls, encryption in transit and restricting access to authorised personnel. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Data retention

We retain personal information for as long as needed to provide the Platform, to meet our legal and record-keeping obligations, and to resolve disputes. When information is no longer required, we take reasonable steps to delete or de-identify it.

9. Accessing and correcting your information

You may request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable period and may need to verify your identity first. Much of your account and building information can also be viewed and updated directly within the Platform.

10. Cookies and analytics

The Platform uses cookies and similar technologies necessary for authentication and to keep you signed in, and may use limited analytics and error-monitoring tools to understand usage and diagnose problems. You can control cookies through your browser settings, though disabling them may affect functionality.

11. Direct marketing

We primarily send service-related communications. If we send you any marketing communications, you can opt out at any time using the unsubscribe mechanism in the message or by contacting us.

12. Complaints

If you have a concern or complaint about how we have handled your personal information, please contact us using the details below and we will investigate and respond. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

13. Changes to this policy

We may update this Privacy Policy from time to time by publishing an updated version. The effective date at the top reflects the latest revision. Continued use of the Platform after a change constitutes acceptance of the updated policy.
